Terms of Service
The agreement between you and Earth Care Network, in plain language.
Version 1.0 (draft) · Effective [release date]
1. Who we are and what these terms cover
Earth Care Network is run by [legal entity] (“Earth Care Network”, “ECN”, “we”, “us”). These terms cover the website at earthcare.network, the app, the API, the Claude connector (MCP server), and the email we send on your behalf. Together we call them “the service”.
Three other documents sit beside these terms:
- The Privacy Policy says what data we collect and what we do with it.
- The Ambassador Agreement applies only if you join the Ambassador program (section 15).
- The licensing overview covers the open-source code (section 16).
By creating an account, ticking the agreement at sign-up, or paying for a plan, you accept these terms.
2. The principles behind these terms
Earth Care Network is built on four ethics: Earth Care, People Care, Future Care, Fair Share. In these terms they mean:
- You own what you make, and you can take it with you.
- You can cancel at any time, and you keep what you paid for until the end of the period.
- We say when something was written by AI, and nothing goes out in your name without a person’s approval.
- We do not sell your data, and claims about the planet have to be true.
3. Accounts and who can use the service
- You must be at least 16 to have an account, and at least 18 (or the age of majority where you live) to buy a plan, sell in a shop, run ads or join the Ambassador program.
- You sign in with a code we email you. There is no password, so keep your email account secure. One account belongs to one person.
- If you create or claim an enterprise, you confirm you are allowed to act for it. The enterprise’s owner is responsible for its workspace and for the teammates they invite. Owners and admins manage the plan and billing.
- Our staff can open your workspace only to help you, through a time-limited access grant that is recorded. A staff grant never signs in as you, and it can never publish, pay or turn on ads for you.
- Tell us straight away if you think someone else has used your account.
4. The alignment agreement
Everyone who joins ticks this agreement, word for word:
Full yes! I agree to leverage universal ethics for the good of all: Earth Care, People Care, Future Care, Fair Share.
It is a shared intention, not a test of belief. We will not close an account because someone disagrees with us. We act only on conduct that breaks section 8.
5. Plans, billing and cancelling
Plans
- People: Free, and Premium.
- Enterprises: Starter, which is free, and Pro.
- The current prices and what each plan includes are on the Plans page and on the payment page before you pay. These are the only plans for sale.
Paying
- Payments are taken by Stripe. We never see or store your card number.
- Paid plans are billed monthly, or yearly where the payment page offers it. They renew automatically until you cancel. Any tax is shown on the payment page.
- Switching from monthly to yearly charges the yearly price at once, less the unused part of your month. Switching from yearly to monthly credits the unused part of your year to your next charges.
- If we change a price, we email you at least 30 days before it applies to your next renewal, so you can cancel first.
Cancelling
Cancel at any time from Membership (people) or Settings (enterprises), or from Stripe’s billing page. Cancelling stops the next charge. Your paid plan stays on until the end of the period you paid for, and then moves to Free or Starter. Nothing you made is deleted.
Refunds
- 14 days to change your mind. Within 14 days of your first payment for a plan, or of a yearly renewal, email us and we refund that payment in full. Your plan then ends straight away.
- Our mistakes. If we charged you twice, charged the wrong amount, or the paid features you bought were unavailable for a long stretch, we refund the affected amount.
- Otherwise we do not refund the rest of a period after you cancel. You keep the paid features until it ends.
- Token packs (extra AI use you buy once) never expire. We refund an unused pack if you ask within 14 days.
If a payment fails
Stripe tries the card again over the following days. Your plan stays on while it does, and we tell you in the app and by email. If Stripe still cannot collect, the subscription ends and your account moves to Free or Starter. Nothing is deleted, and you can pay and move back at any time.
What changes when you move to a free plan
- Pro to Starter: your marketing site keeps being served until the end of the period you paid for, then stops. Your listing page stays up. Other Pro-only features stop: ECN branding comes back, and every email sequence except your first pauses at its next email. Your work is kept, and moving back to Pro brings it back.
- Premium to Free: your page shows ECN branding again, only your first 3 links and first store item stay live, and your subscriber list is hidden. Nothing is deleted, and moving back to Premium brings it all back.
AI use
Plans include a monthly amount of AI use, shown in the app as tokens. Using AI features spends it, and you can buy token packs for more. If you connect your own AI provider key (“bring your own key”), those calls are billed by your provider, not by us.
6. Your content
- You own what you put in or make here: your profile, pages, articles, images, products, contacts and messages.
- To run the service you give us a worldwide, non-exclusive, royalty-free permission to store, copy, format, display and send your content, only to operate the service and to do what you ask: publish your page, send your newsletter, show your shop, or deliver an ad to the platform you chose. We do not use your private content to train AI models, and we do not sell it.
- The permission ends when you delete the content or your account, except for copies already sent to others (an email someone received) and backups, which we delete on the schedule in the Privacy Policy.
- What you publish is public: anyone can see a published profile, site, article or shop, including through the open directory feed. Publishing is always something you choose to do.
- You confirm you have the right to use what you upload, including photos of other people.
- If you send us ideas or feedback, we may use them without owing you anything. You keep the right to use them too.
- You can export your data at any time. Most of it is in the app; for a full export, email us and we answer within 30 days.
7. Contacts and the email you send
When you keep contacts or send newsletters and sequences through the service, you decide who is on your list and what they get. You are responsible for that data, and we handle it on your behalf. You agree to:
- Email only people who asked to hear from you, or whom the law lets you email. Our sign-up forms use double opt-in: a person is subscribed only after they confirm by email.
- Import only lists whose consent you can show. Never upload a bought or scraped list.
- Give a real postal address for your enterprise. Every newsletter and sequence email carries it and an unsubscribe link; we add both, and we stop sending to anyone who unsubscribes.
- Follow the anti-spam laws that apply to you, such as CAN-SPAM in the United States and GDPR in Europe.
We may pause sending from a workspace whose mail draws many bounces or complaints, and we will tell you why.
8. Acceptable use
Do not use the service to:
- Send spam, or message people who have opted out.
- Break the law, or help someone else break it.
- Harass, threaten or discriminate against anyone, or post hateful or sexual content involving minors.
- Pretend to be someone else, or claim an enterprise that is not yours.
- Publish fake reviews, testimonials, customer counts, certifications or results.
- Make environmental claims you cannot back up. “Eco-friendly” with nothing behind it, or “carbon neutral” based only on offsets, is not allowed in ads, and every claim should be specific and true.
- Upload malware, probe or attack our systems, or get around limits, spend caps or metering.
- Copy or scrape the service in bulk, or resell it without a written agreement with us.
- Use someone else’s copyrighted work or trademark without permission.
If something breaks this section, we tell you what and why, and give you a chance to fix it. We act first and explain after only when the law requires it or someone is at risk of harm. You can ask us to look again by replying to our message.
9. AI features and Jaguar
- Jaguar, our AI assistant, and other AI features draft text, suggest actions and make images. AI can be wrong. Check what it writes before you rely on it or publish it.
- AI work is labelled. A draft Jaguar writes is marked Seeded until a person reviews it, and an image AI made carries an “AI illustration” label. We never mark AI output as verified.
- A person approves first. Nothing is sent, published, paid for or turned on without a person on your team approving it, whichever AI is doing the work, including one connected through the Claude connector.
- AI use is metered in tokens, as section 5 describes.
- The AI models are run by other companies, some through OpenRouter. We send them only what a request needs. Whatever you publish is your responsibility, including text an AI wrote.
10. The directory, nominations and claims
- The directory lists regenerative enterprises. A listing can start from public information or from a member’s nomination. Until the owner claims it, a listing uses public facts only and is marked as not yet claimed.
- A nominated listing names the person who nominated it. The nominator takes full responsibility for the nomination until the owner claims the listing.
- An owner claims a listing through the claim link or the claim page. The listing becomes yours only when the claim is confirmed. After that, you control what it says.
- If a listing is about you or your enterprise and you want it corrected or removed, email hello@earthcare.network. We take it down while we check, and a removed listing gets no further invitations.
11. Advertising
Enterprises on Pro can design ads and, where the app allows it, publish them to ad platforms. When you do:
- You are the advertiser. Ads run on your own ad account on the platform you connect (such as Meta, Reddit, LinkedIn or Pinterest). The platform’s terms and ad policies apply, and the platform bills you for the spend. We do not pay, hold or refund ad spend.
- People decide on money. Campaigns are created paused. Only a person with the right role can approve and turn on spend; our AI can design and pause, never publish, turn on or raise a budget.
- Caps. We apply daily, monthly and length limits, shown in the app before you approve, and we may pause an ad that goes past what you approved. Our limits only cover what goes through us, so set a spending limit in the platform too.
- Claims. Section 8 applies to every ad. We block generic and offset-only green claims and stock photos of people by default.
- Measurement. We count results from the links in your ads (their UTM tags). We do not install any ad platform’s tracking pixel on your pages or ours. Privacy Policy section 11 has the detail.
- Some channels are download-only: you get the files and upload them yourself. Publishing may be limited to some workspaces while we roll it out.
12. Other services you connect
Parts of the service run on other companies’ services. Their own terms apply to your use of them:
- Stripe for payments, and Stripe Connect for shop payouts.
- Connected apps you sign in to through Composio or directly, such as ad platforms, social accounts, email and calendars. We act in those accounts only in the ways you approve, and you can disconnect at any time.
- AI model providers, directly or through OpenRouter.
We are not responsible for those services, their outages or their changes, but we will tell you when one affects what you rely on.
13. Shops and selling
- If you sell through a shop on Earth Care Network, you are the seller. The sale is between you and your buyer. You are responsible for your products, descriptions, prices, delivery, returns, customer service and taxes.
- Buyers pay through Stripe. You receive payouts through your own Stripe account once you finish Stripe’s onboarding, and Stripe’s connected-account terms apply.
- We will tell you before we take any fee on your sales. We take none today.
- If you are a buyer, contact the seller first about an order. If that does not work, email us and we will help where we can.
14. Jobs and applications
Enterprises can post roles and people can apply with their page. The enterprise that posts a role is the employer and is responsible for the role and for hiring fairly and lawfully. We do not screen applicants or guarantee any role.
15. Ambassadors
Ambassadors nominate enterprises and earn a commission on their paid membership. The program has its own Ambassador Agreement, which you accept separately. If it and these terms disagree about the program, the Ambassador Agreement wins.
16. Open source
The core of Earth Care Network is open source under the GNU Affero General Public License v3 (AGPLv3); commercial features sit outside it. These terms cover the hosted service we run. They do not limit your rights under the AGPL to the code. The name “Earth Care Network”, the Jaguar and our logos are our trademarks. See the licensing overview.
17. Availability and changes to the service
- We work to keep the service running, but we do not promise it will never be down, slow or wrong. We do not offer an uptime guarantee today.
- We change the service often. Some features are early and switched on for some workspaces first. If we remove a paid feature you rely on, we tell you first, and if it was a main reason you paid, you can cancel and get a refund for the unused part of a yearly plan.
18. Ending your account
- You can cancel a plan at any time, and ask us to delete your account by emailing privacy@earthcare.network. After deletion we remove your data within 30 days, except records the law makes us keep. Export first if you want a copy.
- We may suspend or close an account for a serious or repeated breach of these terms, when the law requires it, or to protect people from harm. We tell you why, and give you time to export your data unless the law or safety prevents it.
- If we ever shut the service down, we give at least 60 days’ notice, time to export everything, and a refund for any unused prepaid period.
- Sections 6 (the parts about content already shared), 19, 20, 21 and 22 still apply after an account ends.
19. What we do not promise
We provide the service “as is”. As far as the law allows, we do not promise it fits a particular purpose, or that directory information, AI output or third-party data is complete or correct. Nothing in the service is legal, financial, tax or investment advice. Your rights as a consumer under the law where you live are not affected.
20. Limits on liability
- Neither of us is liable to the other for indirect or consequential losses, such as lost profits or lost data you could have backed up.
- Our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim, or US$100.
- These limits do not apply to fraud, gross negligence or wilful misconduct, to what you owe us for your plan, or to anything the law does not let us limit.
- If someone makes a claim against us because of content you published, email you sent, an ad you ran or something you sold, you agree to cover our reasonable costs of that claim.
21. Changes to these terms
We may update these terms. For a change that affects you materially, we email account owners and show a notice in the app at least 30 days before it takes effect. If you do not agree, you can cancel before then; if you paid for a year, we refund the unused part. The version and date at the top of this page always show which terms are current.
22. Governing law and disputes
The laws of [state], United States, govern these terms. If something goes wrong, please email us first: most problems are solved that way, and we will try in good faith for 30 days. If that does not work, either of us can go to the courts of [state]. There is no forced arbitration and no waiver of class actions in these terms. If you are a consumer, you can also use the courts and protections of the place where you live.
23. General
- These terms, with the documents in section 1, are the whole agreement between us about the service.
- If a court finds part of them unenforceable, the rest still applies.
- If we do not enforce a part straight away, we have not given it up.
- We may transfer these terms to a company that takes over the service, and we will tell you first. You may not transfer your account without our written agreement.
- We send notices to your account’s email address. You can send yours to the address in section 24.
24. Contact
